1. GENERAL PROVISIONS

  1. PRICE

4.1 Product prices are inclusive of all taxes and duties except for the duties and other charges that may be applied by the customs of the destination country.

4.2 All prices are expressed in Euro.

4.3 Shipping costs are charged to the customer, except for any promotions available on the shipping costs page.

  1. ORDER OF PRODUCTS

5.1 The essential characteristics and prices of the Products are shown in the offer for each Product.

5.2 Orders that come from people who have not reached the age of majority will not be accepted.

5.3 For the purchase of the Products, the Customer must complete the order form online and send it to Antica Enotria in electronic format. Registration with username and password is optional. If the Customer does not wish to register, he can still conclude a purchase: only the data necessary for delivery and the invoicing of an order will be requested.

5.4 The Customer must put the Product in the specific “cart”, enter the personal data, enter the shipping data and, after having read the General Conditions, with particular reference to the contribution for delivery costs, to the operating methods of the right of withdrawal and the Privacy Policy and provided confirmation of having read it, will have to select the desired payment method and choose the “Confirm order” option.

5.5 Before sending the purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained in the Website. 5.6 By sending the order, the Customer acknowledges and declares to have read all the indications provided during the purchase procedure and to fully accept the General Conditions.

5.7 Antica Enotria reserves the right to evaluate the acceptance of orders received. Antica Enotria will inform the Customer of the impossibility to accept orders received within 30 days starting from the day following the day on which the Customer sent the order to Di Martino and will refund any amounts already paid by the Customer for payment of the supply.

5.8 No contract shall be concluded between Antica Enotria and the Customer if Antica Enotria has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered. In such cases, the order submitted by the Customer must be considered as having no effect. Antica Enotria will transmit to the Customer, via e-mail, a communication attesting to the failure to conclude the Contract, also taking care of the cancellation of any charges and / or expenses charged to the Customer.

  1. TERMS OF PAYMENT

6.1 The Customer may make payment of the price of the Products and the related delivery costs by credit card

6.2 Payments made by credit card are accepted

6.3 The transaction will be charged to the Customer’s linked account only after: a) the data has been verified (on a secure server directly by the Bank, Antica Enotria will have no direct access to your data), b) the authorization of charge by the issuing company of the credit card used by the Customer and c) the availability of the Product by Antica Enotria has been confirmed.

6.4 In the event that, for any reason, the debit of the amounts due from the Customer proves impossible, the sales process is automatically canceled and the sale automatically canceled.

  1. CONFIRMATION OF RECEIPT OF THE ORDER

7.1 After receiving an order, Antica Enotria will automatically send an acknowledgment of receipt by e-mail, in which all the details of an order itself, of the essential characteristics of the product ordered, of its price, of the amount paid, of existence will be summarized. of the right of withdrawal – with the indication of the times and methods for the return of the asset – of the geographical address to present any complaints and information on the assistance services and the existing commercial guarantees.

7.2 Following the receipt of an order Antica Enotria will verify the availability of the product ordered and the existence of the other conditions for the sale and only after this verification will it communicate its acceptance of an order and the shipment of the product.

7.3 In the event that Antica Enotria is unable to fulfill an order received it will promptly notify the Customer.

7.4 All rights of the customer to compensation for damages or compensation are excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things caused by the non-acceptance of an order.

  1. TRANSPORT AND DELIVERY

8.1 The Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request delivery of the products to a natural person of his choice. Deliveries to PO Boxes will not be made.

8.2 For each order placed on the Site, Antica Enotria issues an invoice for the goods shipped, sending it together with the package or even by e-mail. For the issuance of the invoice, the information provided by the Customer at the time of the order shall prevail. No change in the invoice will be possible after the issue of the same.

8.3 The delivery costs of the goods are charged to the Customer and are clearly indicated on the Website and in the order form.

8.4 All purchases will be delivered by express courier with which Antica Enotria has stipulated collaboration agreements (hereinafter “Courier”) from Monday to Friday, excluding holidays and national holidays. Antica Enotria is not responsible for unpredictable delays. Antica Enotria will send the Customer a confirmation e-mail once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, the Products will be delivered within a period of 10 (ten) days, subject to delays and in any case no later than 30 (thirty) days from the following day, in compliance with the Consumer Code. to that in which the Customer transmitted the order to Antica Enotria.

8.5 The times indicated for the delivery of the goods are indicative.

8.6 The delivery of the goods requires the presence of the Customer or his representative at the address of the recipient indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the delivery document and that the package is intact or unaltered. Any damage to the package and / or the Products or the mismatch in the number of packages must be immediately disputed through a written control reserve on the Courier’s delivery proof. Once the Courier document has been signed, the Customer will not be able to make any objection to the external characteristics of the package delivered.

  1. DUTIES AND RESTRICTIONS

9.1 Antica Enotria is not responsible for any duties or purchase restrictions applied to customs of the destination countries.

  1. RIGHT OF WITHDRAWAL

10.1 In execution of the provisions of Legislative Decree 21 February 2014, n.21 implementing Directive 2011/83 / EU on consumer rights, the Customer can return the purchased product and obtain a refund of the purchase amount actually paid, without no penalty and without specifying the reason.

10.2 The right of withdrawal consists in the right to return the purchased products to the seller and consequently to obtain reimbursement of the purchase price of the products themselves.

10.3 The right of withdrawal can be exercised within 14 days from receipt of the product in the following ways:

10.3.1 Before the expiration of the aforementioned deadline, the Customer shall send a registered letter with acknowledgment of receipt to Antica Enotria or presenting another declaration from which it is explicitly stated the will to withdraw. 10.3.2 The customer service of the Antica Enotria, having checked the conditions for exercising the right of withdrawal, will contact the consumer in order to indicate the place where he will have to return the intact products, within fourteen days, excluding holidays and weekends , starting from the date of communication of the withdrawal.

10.4 The costs of returning the purchased products are borne by the consumer.

10.5 In the event that the value of the products has suffered a decrease caused by a manipulation different from that necessary to establish the nature, characteristics and functioning of the products, (for example: damaged products, not packed regularly or completely, or in which certain parts are missing or have been damaged, such as components, elements, accessories, packaging materials, boxes, documentation and / or other objects), Antica Enotria will reimburse the Customer for the purchase sum less the value of said decrease.

10.6 In the event that the Customer returns products other than the above term or in the case of products that are open and / or partially used and that do not lend themselves to being returned, the right of withdrawal does not apply and Antica Enotria will return them to the Customer the good purchased by charging the same shipping costs.

10.7 With the aforementioned limitations, Antica Enotria will reimburse the amount actually paid by the Customer within 14 days of receipt of the notice of withdrawal, by bank transfer.

  1. CONFORMITY DEFECTS, WARRANTY AND REPLACEMENT

11.1 The sale of products other than foodstuffs is subject to the legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code. To benefit from the guarantee, the customer must keep the invoice, or, where non-existent, the transport document.

11.3 The Customer has the right to restore, without charge, the conformity of the goods by substitution or an adequate price reduction or the termination of the contract.

11.4 The Customer loses these rights, if he does not report the lack of conformity to Antica Enotria within two months from the date on which he discovered the defect. The direct action to assert defects not fraudulently concealed by Antica Enotria is prescribed, in any case, within twenty-six months from delivery of the goods.

11.5 If the purchased product appears to have been damaged during transport, the Customer may request its replacement within the mandatory period of 10 days from receipt.

11.7 The execution of the new order is subject to the availability of the requested Products.

13.1 These General Conditions are governed by Italian law and must be interpreted in compliance with Italian laws.

13.2 For disputes arising from the interpretation, validity and / or execution of these General Conditions the mandatory territorial jurisdiction will be that of the judge of the Court of Trani.
